Are all employees who suffer a work injury in Pennsylvania covered by the Pennsylvania Workers’ Compensation Act?

No. There are some classifications of workers who are not covered by the Pennsylvania Workers’ Compensation Act. Such workers include federal employees, military personnel, maritime workers and railroad workers, who have coverage through other laws, some of which include the Federal Employees’ Compensation Act, Jones Act, Longshoremen’s and Harbor Workers’ Compensation Act and the Federal Employer’s Liability Act.

There are other classifications of employees who may also not have coverage under the Pennsylvania Workers’ Compensation Act. These include domestic workers, agricultural workers, real estate salespeople and brokers, and insurance agents. Furthermore, independent contractors may not be covered by the Pennsylvania Workers’ Compensation Act because they are not employees. Whether an injured worker is covered by the Workers’ Compensation Act is frequently dependent on facts of each case. An attorney who is versed in workers’ compensation law will be able to determine this.
