How can I recover lost earnings?

Generally, temporary disability benefits are given at the rate of 70 percent of the employee’s average weekly wage. However, there is a maximum amount a worker can receive every year. There is an award of temporary disability benefits at a time when an employee is unable to go back to work, and is receiving medical treatment. The least amount of time during which such benefits are awarded is seven days.

Usually, disability benefits terminate when the employee goes back to work on a part-time or full-time basis, or if the employee attains the state of maximum medical improvement. This is the stage at which any further medical treatment cannot help the injured employee get better. An employee’s benefits can also be terminated if they are not promoting the employee’s health.
