I am out of work due to an injury on the job site. Can I be fired because of that injury?

No, you cannot be fired from work because of an injury sustained on the job site. Per workers’ compensation laws, your employer is barred from terminating a work in retaliation for filing a workers’ compensation claim, or for testifying at a hearing.

If you were fired because of your condition, you may be able to file a claim that asserts being fired violated the Americans with Disabilities Act (ADA). Other legal options may be open to you. Discuss these with a skilled workers’ compensation attorney.

If your employer does not have workers’ compensation insurance, let us know at Petrillo & Goldberg Law. There may be other options for you to obtain the compensation you need to move forward with your life and pay medical costs.

In some cases, workers’ compensation may not be the best option for your situation, as your medical needs may be far greater than the benefits provided by workers’ compensation. In situations like that, an injured worker may sue their employer if negligence was involved in the accident that caused the worker’s injury. Filing a personal injury lawsuit may result in an injured worker obtaining the funds needed to pay for extensive medical care.
