What is an employee under Pennsylvania Workers’ Compensation Act?

Workers’ compensation is a no-fault insurance that employers must carry in Pennsylvania to cover their employees in case of work-related accidents and associated injuries, illnesses or deaths. The insurance provides financial coverage to injured employees for medical care, wage compensation, disability benefits, and if applicable, death benefits. For an injured worked to be eligible for workers’ compensation benefits, they must be an employee as defined by state law.

The general definition of an employee is a person who is hired by another person or entity for a wage, salary, fee or payment. Independent contractors may also be considered employees if the hiring person or entity has the right to control the independent contractor’s activities.
