What is the deadline to file a workers’ compensation claim?

Worker’s compensation claims arise when an employee has a workplace or work-related accident that causes or leads to injury, illness, or death. The laws which govern workers’ compensation in Pennsylvania are in the state’s Workers’ Compensation Act. The Act applies to all employment-related injuries, illnesses, and deaths that occur within the state of Pennsylvania, even if the hiring, renewal, or extension of the employee took place somewhere else. Workers’ compensation is no-fault insurance that cover employees for injuries, illnesses, or death while in the scope of scope of their employment.

To receive compensation, the employee must receive notice from the employee or, in the circumstance of death, the surviving family members. The employee must give the notice within the deadline set forth under Pennsylvania law. The employer must receive notice of the employee’s injury or occupational disease within 120 days after the injury or disease. The clock usually begins when on the date of the injury. However, certain work-related injuries and illness may not be discovered until days or months after the accident. In those cases, the time for notice begins with the injury or illness is or should have been discovered by the employee seeking workers’ compensation. Failure to meet the deadline means that the employee is not allowed to receive compensation for the injury or disease he or she is claiming. If the employee receives timely notice and denies the claim, the employee may file a petition with the Pennsylvania Bureau of Workers’ Compensation. The employee has three years from the date or discovery of the injury or illness to file the claim petition.
