What is the New Jersey Division of Workers’ Compensation?

The New Jersey Division of Workers’ Compensation is a division with the State of New Jersey Department of Labor and Workforce Development. Workers’ compensation is the exclusive remedy in New Jersey for compensation for a work-related accident resulting in injury, illness, or death of an employee. The Division is responsible for the administration and application the state workers’ compensation laws. It reviews and resolves disputes that arise in workers’ compensation claims. It consists of fifteen workers’ compensation courts throughout the state of New Jersey.

The Division handles workers’ compensation issues such as whether the accident was work-related, medical treatment, payment of medical expenses, payment of disability benefits, calculation and distribution of wage compensation payments. The also regulates and enforces the employers’ obligations under the workers’ compensation laws. It makes sure that employers have the required workers’ compensation insurance and penalizes them if they failure to maintain adequate insurance coverage on their employees. When an employee is injured or killed in a work-related accident, the injured employee or surviving family members may seek compensation by filing a petition for formal claim or application for an informal hearing with the Division.
