When does workers’ compensation end?

The exclusive remedy in New Jersey for employees to receive benefits for work-related injuries and illness is workers’ compensation. It covers the medical expenses that arise from the injury or illness. The benefits also provide wage compensation to injured employees until their doctors clear them to return to work. However, their doctors may conclude they are unable to return to any gainful employment.

Workers’ compensation includes disability benefits, which are paid as a weekly wage replacement. Depending on the type of benefits an injured employee is eligible for, the length of time the employee receives worker’s compensation ranges from a short time or for the rest of their life. The types of disability benefits an injured worked may be eligible for are:

A worker with TTD receives workers’ compensation benefits until their doctor releases them to return to work or when additional treatment will not improve the medical condition. However, TTD benefit payments are only paid for up to 400 weeks. Eligibility for PTD benefits is met when an employee has a work injury or illness that prevents them from returning to gainful employment. The initial time period for weekly PTD payments is 450 weeks. Payments continue beyond the initial 450 weeks if the employee is still unable to return to work. Permanent partial disability benefits do not have one set end date. The terms for PPD are different for each type of disability. For example, an injured employee may receive compensation for loss of a thumb for 80 weeks and loss of an arm for 330 weeks.
