Is it advisable to accept a settlement offer from the insurance company?

No, the insurance company will try to pay the least amount that it possibly can, and will attempt to increase its profit. The insurance adjuster’s objective is to pay the plaintiff as little as possible, and will likely be rewarded for doing so. That is why an insurance adjuster may often visit the plaintiff shortly after an accident.

The adjuster may make an offer in an amount that is much less than what you could recover in a lawsuit. However, in order to avoid a lawsuit, the adjuster may make an offer immediately at a time when the plaintiff is most vulnerable, and possibly in need of financial assistance. At this time, the plaintiff has more than likely not even had an opportunity to consider the available options. Therefore, it is best to consult legal counsel prior to communicating with anyone from the insurance company.
